Government to Launch Criminal Investigation into BP Oil Spill Disaster

The U.S. government has launched a widely expected criminal and civil investigation into BP’s massive oil spill in the Gulf of Mexico, U.S. Attorney General Eric Holder said on Tuesday, ratcheting up the pressure on the beleaguered British oil company.

“We have begun both a criminal as well as a civil investigation as is our obligation under the law,” Holder told reporters after meeting with state and federal prosecutors in New Orleans. “Our environmental laws are very clear.”

Federal agencies, including the FBI, are participating in the probe and “if we find evidence of illegal behavior, we will be forceful in our response,” he said, adding that prosecutors had a “sufficient basis” to start a criminal probe.

After taking a tour of the oil spill, Holder said he saw “oil for miles and miles, oil that we know has already affected plant and animal life among the coast.”

The Justice Department has already demanded that the companies involved in the spill, including BP, Transocean Ltd. and Halliburton Co. preserve records related to the accident.

The Justice Department will examine the companies’ actions for violations under the Clean Water Act, the Endangered Species Act, the Migratory Bird Treaty Act and the Oil Pollution Act of 1990, which can be used to hold them liable for cleanup costs and reimbursement for government efforts.

Additionally, the Justice Department could pursue other traditional charges if they find the companies made false statements or obstructed the investigation.

“As our review expands in the days ahead, we will be meticulous, we will be comprehensive, and we will be aggressive,” Holder told reporters. “We will not rest until justice is done.”

‘Top kill’ BP operation to halt US oil leak fails

The latest attempt to stop the Gulf of Mexico oil leak has failed, the oil giant BP has said.

BP chief operating officer Doug Suttles said the firm was now shifting to a new strategy to stop the spill. In the failed procedure – known as “top kill” – the firm had been blasting waste material and heavy mud into a ruptured well. US President Barack Obama said the continued flow of oil was “as enraging as it is heartbreaking”. The worst oil spill in US history began when a drilling rig exploded and sank last month, killing 11 people.

The thick crude has already permeated more than 70 miles (110km) of Louisiana’s coastline, threatening fragile wetlands and putting the vital fishing industry at risk.

Mr Suttles said BP had determined that the “top kill” method – which had been going on since Wednesday – had failed after studying the results for three days. “We have not been able to stop the flow,” he told reporters on Saturday.

“This scares everybody, the fact that we can’t make this well stop flowing, the fact that we haven’t suceeded so far,” he said.

The company says it pumped 30,000 barrels of mud into the well, in three attempts, at rates of up to 80 barrels a minute, but it had not worked. It is the latest procedure to have failed since attempts to plug the leak began, with BP having spent more than $940 million so far.

Oil Reaches Louisiana Shores

“Over one month after the initial explosion and sinking of the Deepwater Horizon oil rig, crude oil continues to flow into the Gulf of Mexico, and oil slicks have slowly reached as far as 12 miles into Louisiana’s marshes. According to Louisiana Governor Bobby Jindal, more than 65 miles of Louisiana’s shoreline has now been oiled. BP said it will be at least Wednesday before they will try using heavy mud and cement to plug the leak, a maneuver called a “top kill” that represents their best hope of stopping the oil after several failed attempts. Based on low estimates, at least 6 million gallons of crude have spewed into the Gulf so far – though some scientists have said they believe the spill already surpasses the 11 million-gallon 1989 Exxon Valdez oil spill off Alaska as the worst in U.S. history.”
